These Terms and Conditions govern the use of the Simply Design website and the services we provide. By accessing or using our website or engaging our services, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our website or services.

About Us

Simply Design is a creative studio based in Mullingar, Co. Westmeath, Ireland. We provide web design, branding, print design and related services. The laws of Ireland govern these Terms and Conditions, and any disputes shall fall under the exclusive jurisdiction of the Irish courts.

Use of Our Website

You may use our website for lawful purposes only. You must not attempt to damage, disrupt or gain unauthorised access to the website, or use it in any way that could harm Simply Design or other users.

Services

We offer services including web design, e-commerce development, branding, logo design and print design. Full details, timelines and costs are agreed individually with each client before work begins. Engaging our services constitutes acceptance of these Terms and Conditions.

Quotes and Pricing

All quotes are estimates based on the project scope outlined at the time of quoting. If the scope changes, pricing will be revised accordingly. Any additional work requested beyond the agreed scope will be quoted and charged separately before proceeding.

Payment Terms

Payments must be made in accordance with the schedule agreed before the project commences. Simply Design reserves the right to pause work if payments are not received on schedule. Final files, websites or materials will not be released until all outstanding payments have been received in full.

Deposits

A deposit is required to secure your project start date. Deposits are non-refundable once work has commenced, as they cover time allocated and any preparatory work carried out.

Client Responsibilities

Clients are responsible for providing accurate information, content, images and materials required for their project in a timely manner. Delays in supplying content may result in extended project timelines, for which Simply Design is not liable. Clients must ensure they hold all necessary rights to any materials they supply.

Project Timelines

Estimated timelines are provided for each project and are subject to change due to client delays, scope changes or unforeseen circumstances. Simply Design will notify the client of any significant changes to the agreed timeline.

Revisions

The number of included revision rounds is outlined in each individual project proposal. Additional revisions requested beyond the agreed amount will be charged at our standard hourly rate.

Custom Designed and Printed Products

All custom designed and printed products — including printed materials, branded merchandise, books and board games — are produced specifically to each client’s requirements and are non-returnable and non-refundable once approved for print and production.

We work with trusted external print partners based in Ireland, Germany, Italy and other EU countries to produce your order. While we take care to work with reliable suppliers, delivery timescales can occasionally be affected by factors outside our direct control, including production schedules, courier delays, customs handling or other circumstances on the supplier’s end. We will always do our best to keep you informed if a delay arises.

In the event that goods arrive damaged in transit, the client must contact Simply Design at hello@simplydesign.ie within 48 hours of delivery, providing photographic evidence of the damage. Claims received outside this window may not be accepted. Where a valid damage claim is confirmed, Simply Design will arrange a replacement or suitable remedy at our discretion.

Website Content and Ownership

Upon receipt of full payment, the client owns the final approved design files and website. Simply Design retains the right to display completed work in our portfolio unless the client requests otherwise in writing.

Intellectual Property

All work created by Simply Design remains our intellectual property until full payment has been received. Unpaid work may not be used, published, reproduced or distributed in any form.

Projects may incorporate third-party licensed assets such as stock images, fonts or plugins. These assets may be subject to their own licensing terms, which continue to apply after project delivery. Clients are responsible for ensuring ongoing compliance with any such third-party licences.

Third-Party Services

Certain services — including hosting, domain registration, payment gateways and email — are provided by third-party suppliers. Simply Design is not responsible for the performance, availability or policies of these services. Clients are responsible for reading and agreeing to the terms of any third-party services used as part of their project.

Limitation of Liability

Simply Design is not liable for any loss, damage or business interruption arising from website issues, downtime, hacking, hosting failures or third-party service disruptions. We do not guarantee that any website will be entirely error-free or available at all times.

Data Protection

We process personal data in accordance with GDPR and applicable Irish data protection law. Please refer to our Privacy Policy for full details on how we collect, use and store personal information.

Cancellation

Either party may cancel a project by providing written notice. All work completed up to the date of cancellation must be paid for in full. Deposits are non-refundable once work has commenced.

Disputes

In the event of a dispute, both parties agree to first attempt to resolve the matter informally by contacting Simply Design at hello@simplydesign.ie. If a resolution cannot be reached, the matter will be subject to the jurisdiction of the Irish courts.

Changes to These Terms

We may update these Terms and Conditions from time to time. The current version will always be available on this page, with the date of last update noted above. For ongoing clients, we will endeavour to notify you of any material changes. Continued use of our website or services following any update constitutes acceptance of the revised terms.
